Participation Agreement, Assumption of Risk, Medical Authorization & Parent/Guardian Consent

This Participation Agreement ("Agreement") establishes the terms and conditions governing participation in programs, classes, workshops, field trips, guided outings, events, and activities offered by Kolibri Education & Consulting, LLC ("Kolibri").
Kolibri provides educational, recreational, and experiential learning opportunities designed to foster curiosity, practical skill development, personal growth, environmental stewardship, and meaningful engagement with the natural world. Programs are conducted in a variety of settings, including parks, forests, trails, waterways, educational facilities, public lands, private property (with permission), shooting ranges, community locations, and other approved sites.
Programs may include, but are not limited to:
Guided hiking and outdoor recreation
Outdoor education and environmental studies
Nature observation and journaling
Science, STEM, and field investigations
Fishing and aquatic exploration
Creek, stream, river, pond, and lake activities, including shoreline access and wading where permitted
Orienteering and navigation
Survival and outdoor living skills
Shelter building
Fire building and outdoor cooking where authorized
Responsible knife, tool, and equipment use
Archery instruction
Firearm safety education and supervised marksmanship activities
Arts, crafts, and creative projects
Homeschool enrichment programs
Family programs
Adult education programs
Youth programs
Special events, retreats, consulting activities, demonstrations, volunteer activities, and other educational experiences offered by Kolibri.
This Agreement applies to all Kolibri programs unless a separate written agreement expressly states otherwise. Certain activities may require participants to sign additional program-specific acknowledgements or safety agreements.
Kolibri Education & Consulting, LLC provides educational enrichment, outdoor recreation, experiential learning, and consulting services. Kolibri is not an accredited school, licensed childcare provider, healthcare provider, mental health provider, or emergency response agency. Participants remain responsible for obtaining any educational, medical, mental health, childcare, or emergency services that may be appropriate outside the scope of Kolibri's Programs.

For purposes of this Agreement:
"Kolibri" means Kolibri Education & Consulting, LLC, together with its owner, instructors, employees, assistants, volunteers, contractors, guest instructors, and authorized representatives.
"Participant" means any adult participating in a Kolibri program or any minor participating with the permission of a parent or legal guardian.
"Parent/Guardian" means the legal parent or legal guardian authorized to sign on behalf of a minor participant.
"Program" means any class, course, workshop, field trip, guided hike, lesson, retreat, consultation, demonstration, event, transportation provided in connection with a program, or other activity organized, sponsored, or conducted by Kolibri.
"Outdoor Environment" includes natural areas, trails, forests, fields, waterways, parks, campsites, educational properties, farms, public lands, private lands used with permission, parking areas, and all travel between activity locations that occurs as part of a Program.

Participants are responsible for ensuring that they, or their minor child, are physically and emotionally capable of safely participating in the Program for which they have registered.
Some Programs may have age requirements, prerequisite skills, equipment requirements, or supervision requirements. Participants agree to comply with all published eligibility requirements.
Unless expressly stated otherwise by Kolibri in writing:
Participants under the age of 18 may participate only with the authorization of a parent or legal guardian.
Minor participants attending adult programs must remain accompanied throughout the Program by their registered parent or legal guardian.
Parents or guardians remain responsible for their minor child's behavior, supervision requirements, and compliance with Program rules except where Kolibri expressly assumes supervision as part of a designated drop-off youth program.

I understand that participation in Kolibri Programs is voluntary and that many activities take place in outdoor, natural, or other dynamic environments where conditions may change rapidly and hazards cannot be entirely eliminated, even when reasonable care is exercised.
I acknowledge that participation involves inherent risks that may include, but are not limited to:
Slips, trips, falls, loss of footing, or collisions with people, objects, or natural features.
Uneven terrain, loose rocks, roots, mud, gravel, steep slopes, cliffs, fallen trees, bridges, boardwalks, and other natural or constructed features.
Exposure to changing weather conditions, including heat, cold, humidity, rain, snow, ice, wind, lightning, poor visibility, and sudden weather changes.
Sun exposure, dehydration, heat exhaustion, heat stroke, hypothermia, fatigue, overexertion, or other environmental conditions.
Natural bodies of water, including streams, rivers, lakes, ponds, wetlands, and shoreline areas, where slipping, falling, strong currents, submerged hazards, changing water conditions, or accidental immersion may occur.
Encounters with wildlife, including insects, ticks, mosquitoes, bees, wasps, spiders, snakes, fish, birds, mammals, and other domestic or wild animals.
Exposure to poisonous plants, allergens, pollen, fungi, poison ivy, poison oak, poison sumac, thorns, briars, or other naturally occurring vegetation.
Bites, stings, scratches, allergic reactions, infections, insect-borne illnesses, or other naturally occurring environmental hazards.
Use of hand tools, knives, saws, axes, carving tools, fishing equipment, fire-starting equipment, cooking equipment, ropes, navigation equipment, scientific equipment, sporting equipment, archery equipment, firearms, or other instructional equipment used as part of supervised educational activities.
Injuries resulting from physical activity, lifting, carrying equipment, running, climbing, balancing, jumping, kneeling, sitting, standing, or other ordinary movements associated with outdoor recreation and education.
Risks associated with transportation to, from, or between Program locations when transportation is provided by Kolibri in connection with a Program.
Delayed access to emergency medical services due to remote locations, weather, terrain, or other circumstances beyond Kolibri's control.
The acts or omissions of other participants or members of the public.
I understand that no program, activity, instructor, or safety procedure can eliminate every risk associated with participation.
I voluntarily choose to participate, or permit my minor child to participate, with knowledge and acceptance of these inherent risks. I accept personal responsibility for my own participation and, where applicable, for the participation of my minor child.
I understand that it is my responsibility to exercise reasonable judgment, communicate any concerns to Kolibri staff, and immediately report any injury, illness, unsafe condition, or equipment concern observed during a Program.
Nothing in this Agreement is intended to waive or limit any rights or protections that cannot lawfully be waived under applicable Maryland law.

To help promote a safe, respectful, and enjoyable experience for everyone, Participants agree to the following responsibilities throughout each Program.
General Responsibilities
Participants agree to:
Follow all safety instructions, policies, and directions provided by Kolibri staff.
Exercise reasonable care for their own safety and the safety of others.
Treat fellow participants, instructors, volunteers, members of the public, wildlife, and property with courtesy and respect.
Remain with the group unless permission is given by a Kolibri instructor.
Immediately report any injury, illness, unsafe condition, damaged equipment, or emergency to Kolibri staff.
Participate only in activities that they feel physically capable of performing and promptly notify staff if they become unable to continue safely.
Wear clothing and footwear appropriate for the Program and expected weather conditions.
Bring any required equipment, medications, food, water, or other personal items identified before the Program.
Use all tools, sporting equipment, instructional materials, and safety equipment only as instructed.
Health and Medical Responsibilities
Participants are responsible for:
Providing accurate and complete medical and emergency contact information during registration.
Informing Kolibri of any changes to relevant medical information before participating.
Carrying any personal medications that may be needed during the Program, including emergency medications such as inhalers, epinephrine auto-injectors (EpiPens), diabetic supplies, or other physician-prescribed medications.
Informing Kolibri staff of any medical condition or allergy that may require emergency assistance.
Kolibri staff are not responsible for reminding participants to take medications or for carrying personal medications unless otherwise agreed to in writing.
Care of Equipment and Property
Participants agree to use reasonable care when using equipment provided by Kolibri.
Participants may be responsible for damage resulting from intentional misuse, reckless behavior, or failure to follow safety instructions.
Environmental Stewardship
Participants agree to help protect the natural areas visited during Programs by:
Respecting wildlife and observing animals from an appropriate distance.
Avoiding unnecessary disturbance of plants, habitats, and natural features except as part of supervised educational activities.
Properly disposing of trash and leaving Program locations clean.
Following Leave No Trace principles whenever reasonably applicable.
Complying with all applicable laws, park regulations, posted signs, and landowner requirements.
Right to Modify or Remove a Participant
Kolibri reserves the right to modify activities, change locations, postpone or cancel Programs, or remove a Participant from any Program when reasonably necessary to protect the safety, well-being, or enjoyment of participants, staff, property, or the public.
Removal from a Program for unsafe, disruptive, threatening, or unlawful behavior may occur without refund, subject to Kolibri's published policies.

This section applies whenever a Participant is under eighteen (18) years of age.
By registering a minor Participant, I certify that I am the minor's parent or legal guardian, or that I have the legal authority to authorize the minor's participation in the Program.
I understand and agree that:
I have reviewed the information provided about the Program and believe the minor Participant is physically, emotionally, and developmentally capable of participating.
I have disclosed all known medical conditions, allergies, medications, behavioral concerns, or other information that may reasonably affect the minor's safe participation.
I authorize the minor Participant to take part in the activities described for the Program, including those reasonably incidental to the Program.
I understand that outdoor and educational activities involve inherent risks, as described in this Agreement, and I have discussed appropriate safety expectations with my child to the extent appropriate for their age and maturity.
Supervision
Unless Kolibri has expressly designated a Program as a drop-off program, I understand that I remain responsible for supervising my minor child throughout the Program.
For Programs that require an accompanying adult, including adult Programs that permit minor Participants, I understand that my child must remain accompanied by me or another approved registered adult for the duration of the Program.
For designated drop-off Programs, I understand that supervision is limited to scheduled Program hours and activities. I agree to ensure that my child is dropped off and picked up in accordance with Kolibri's published procedures and at the designated times.
Participant Conduct
I understand that I remain responsible for helping my child understand and follow Program rules and expectations.
If my child's behavior presents a safety concern, substantially disrupts the Program, or prevents Kolibri staff from safely supervising the group, I understand that I may be required to pick up my child before the scheduled end of the Program. Any refund will be governed by Kolibri's published policies.
Emergency Contact
I agree to remain reasonably available, or ensure that another authorized emergency contact remains reasonably available, while my child is participating in the Program.
I will promptly notify Kolibri if my emergency contact information changes before or during the Program.
Ongoing Responsibility
I understand that my authorization applies only to the Program(s) for which I have registered my child and that I am responsible for notifying Kolibri of any material changes to my child's health, medications, emergency contacts, or other information that may affect safe participation before future Programs.

The health and safety of Participants are important to Kolibri. While Kolibri staff will make reasonable efforts to respond appropriately to emergencies, Participants and Parent/Guardians understand that Kolibri is not a medical provider and does not provide medical diagnosis or treatment.
Authorization for Emergency Care
If I, or my minor child, become ill or injured during a Program, I authorize Kolibri to take reasonable actions that staff believe are appropriate under the circumstances, including but not limited to:
Providing basic first aid within the scope of the staff member's training and certification.
Contacting emergency medical services (911).
Arranging transportation by emergency responders to an appropriate medical facility when deemed reasonably necessary.
Contacting the emergency contact(s) provided during registration.
I understand that Kolibri will make reasonable efforts to notify me or my designated emergency contact as soon as practicable.
Medical Information
I certify that the medical information provided during registration is complete and accurate to the best of my knowledge.
I understand that it is my responsibility to notify Kolibri before the Program begins if there are any changes to medical conditions, medications, allergies, emergency contacts, or other information that may affect safe participation.
Medications
Participants are responsible for bringing any personal medications they may require during the Program, including emergency medications such as inhalers, epinephrine auto-injectors (EpiPens), diabetic supplies, or other prescribed medications.
Unless otherwise agreed to in writing, Kolibri staff are not responsible for storing, carrying, reminding Participants to take, or administering personal medications.
Medical Expenses
I understand that I am solely responsible for any medical evaluation, treatment, transportation, hospitalization, medication, or other healthcare expenses incurred as a result of illness or injury during or following participation in a Program.
Limitation of Medical Services
I understand that Program locations may be in outdoor or remote environments where emergency medical services may be delayed due to terrain, weather, traffic, limited cellular service, or other circumstances beyond Kolibri's control.
I acknowledge that Kolibri cannot guarantee immediate access to emergency medical care or advanced medical treatment.

Some Programs may include transportation provided by Kolibri when reasonably necessary to facilitate Program activities or travel between approved Program locations. Transportation is not included in every Program and will only be provided when communicated by Kolibri.
When transportation is provided, Participants and Parent/Guardians understand and agree to the following:
Transportation may be provided by Kolibri staff or an authorized representative using an approved vehicle.
Participants are expected to follow all safety instructions while entering, riding in, and exiting the vehicle.
Seat belts or other legally required occupant restraints must be worn at all times while the vehicle is in motion.
Participants shall avoid conduct that distracts the driver or creates an unsafe environment for others.
Pick-up and drop-off times and locations must be followed unless alternative arrangements have been approved by Kolibri.
Parents and Guardians authorize Kolibri to transport their minor child only when transportation is provided as part of a Program and appropriate permission has been granted through the registration process or other written communication.
Kolibri reserves the right to decline transportation for any Participant when doing so is reasonably necessary for safety, legal compliance, vehicle capacity, or operational considerations.
Participants understand that travel by motor vehicle, like all forms of transportation, involves inherent risks that cannot be completely eliminated despite the exercise of reasonable care.

Kolibri Education & Consulting values the privacy of its participants while also documenting Programs for educational, commemorative, and promotional purposes.
Public Use of Images
Participants and Parent/Guardians understand that Kolibri may take photographs or video during Programs.
For public marketing, educational materials, printed publications, presentations, social media, and the Kolibri website, Kolibri's practice is to use images in which individual participants are not reasonably identifiable. This may include photographs showing participants from behind, at a distance, with faces obscured, or otherwise photographed in a manner that does not reasonably identify a specific individual.
Private Sharing
From time to time, Kolibri may share additional photographs or videos with enrolled participants and their families through private means, such as password-protected galleries, private messaging groups, email, or similar communications intended only for Program participants.
Participants and Parent/Guardians understand that, despite Kolibri's efforts to limit distribution, Kolibri cannot guarantee or control how images shared privately may later be copied, downloaded, or redistributed by others.
Photographs Taken by Others
Many Programs take place in public parks, trails, community spaces, and other locations where members of the public may also take photographs or record video.
Kolibri does not control photography, video recording, or other media created by members of the public or by other participants.
Participant Photography
Participants are welcome to take photographs for their own personal use provided doing so does not interfere with Program activities, compromise safety, violate park or property rules, or unreasonably infringe upon the privacy of others.
Kolibri reserves the right to restrict photography or recording during certain instructional activities when reasonably necessary for safety, privacy, or educational purposes.
Questions or Concerns
Participants or Parent/Guardians who have questions or concerns regarding photography or media practices are encouraged to discuss them with Kolibri before the Program begins.

Certain Kolibri Programs may include specialized educational or recreational activities that require additional instruction, safety equipment, or participant responsibilities. Participation in these activities is voluntary unless they are identified as a required component of a specific Program.
Depending on the Program, specialized activities may include, but are not limited to:
Archery
Firearm safety education
Supervised marksmanship activities
Responsible knife and tool use
Fishing
Fire building and outdoor cooking
Shelter building
Navigation and orienteering
Creek, stream, river, pond, or lake exploration
Scientific investigations and field studies
Other outdoor skills or educational activities introduced by Kolibri.
Participants agree to:
Carefully follow all safety instructions provided by Kolibri staff before and during each activity.
Use equipment only for its intended instructional purpose and only as directed.
Immediately notify Kolibri staff of any damaged, defective, or unsafe equipment or conditions.
Refrain from using equipment in a careless, reckless, or unauthorized manner.
Ask questions whenever instructions are unclear before participating.
Participants understand that failure to follow safety instructions may increase the risk of injury to themselves or others and may result in removal from the activity or Program.
Firearm Safety and Marksmanship Programs
Participants in firearm safety education or supervised marksmanship Programs understand that firearms require strict adherence to established safety procedures at all times.
Participants agree to comply with all instructor directions, range rules, and safety commands without delay.
Kolibri may immediately remove any Participant from a firearm-related activity if, in the judgment of the instructor, the Participant's conduct presents an actual or potential safety risk.
Certain specialized Programs, including firearm safety and marksmanship instruction, may require Participants to complete additional activity-specific acknowledgements or safety agreements before participating.
Modification of Activities
Kolibri reserves the right to modify, postpone, substitute, or cancel any activity when reasonably necessary due to weather, environmental conditions, equipment availability, participant safety, instructor judgment, governmental restrictions, or other circumstances beyond Kolibri's reasonable control.
Such modifications are intended to promote participant safety and maintain the educational objectives of the Program whenever reasonably possible.

Kolibri Programs are designed to take advantage of authentic learning opportunities in dynamic environments. As a result, Program activities, locations, schedules, and instructional plans may be modified when reasonably necessary to promote participant safety, comply with applicable laws or property requirements, respond to changing environmental conditions, or support the educational objectives of the Program.
Participants and Parent/Guardians understand that Kolibri may, in its reasonable discretion:
Modify, substitute, or rearrange planned activities.
Change Program locations or routes.
Adjust the length or timing of activities.
Limit or discontinue specific activities.
Delay, postpone, reschedule, or cancel a Program when conditions warrant.
Examples of circumstances that may require changes include, but are not limited to:
Severe or hazardous weather.
Excessive heat or cold.
Lightning, flooding, high water, poor water quality, or other environmental hazards.
Poor air quality, wildfire smoke, or other public health concerns.
Trail, park, range, or facility closures.
Unsafe site conditions.
Wildlife activity or environmental hazards.
Instructor illness, emergency, or unavailability.
Equipment failure.
Government orders, public safety advisories, or other circumstances beyond Kolibri's reasonable control.
Whenever reasonably practicable, Kolibri will make reasonable efforts to notify Participants of significant Program changes as soon as possible.
Program modifications made in good faith for safety, educational, or operational reasons shall not, by themselves, constitute a breach of this Agreement.
Nothing in this section alters any refund, cancellation, or rescheduling policy separately published by Kolibri.

Governing Law
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Maryland, without regard to its conflict of law principles.
Severability
If any provision of this Agreement is determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.
Entire Agreement
This Agreement, together with any Program-specific registration materials, published policies, or activity-specific acknowledgements incorporated by reference, constitutes the entire agreement between the Participant (or Parent/Guardian) and Kolibri regarding participation in the applicable Program.
No Waiver
A failure by Kolibri to enforce any provision of this Agreement on one occasion shall not constitute a waiver of its right to enforce that or any other provision on a future occasion.
Electronic Signatures
Participants and Parent/Guardians agree that electronic signatures, electronic acknowledgements, and electronic acceptance of this Agreement, including those submitted through online registration systems, shall have the same force and effect as an original handwritten signature to the extent permitted by applicable law.
Modifications
Kolibri may revise this Agreement from time to time. Any revised version will apply prospectively to Programs registered for after the revised Agreement becomes effective and will not apply retroactively unless required by law or expressly agreed to by the Participant or Parent/Guardian.
Questions
Participants and Parent/Guardians acknowledge that they have had the opportunity to read this Agreement, ask questions regarding its contents, and seek independent advice if they chose to do so before agreeing to its terms.

This Agreement is incorporated into each Kolibri Program registration. By electronically accepting the applicable Program registration, I acknowledge and agree to the terms of this Agreement.
I have had the opportunity to read this entire Agreement before participating in a Kolibri Program.
I understand that this Agreement applies to my participation, or to the participation of my minor child, in the applicable Program together with any Program-specific registration materials or activity-specific acknowledgements.
I have had the opportunity to ask questions regarding this Agreement before agreeing to its terms.
The information I have provided during registration, including medical and emergency contact information, is true and complete to the best of my knowledge.
I understand that participation in Kolibri Programs involves inherent risks that cannot be completely eliminated, and I voluntarily choose to participate, or permit my minor child to participate, with knowledge of those inherent risks.
I understand that I am responsible for complying with the safety expectations, responsibilities, and policies described in this Agreement.
I understand that additional safety instructions may be provided before or during individual activities and agree to follow those instructions.
I understand that this Agreement is intended to promote a safe, respectful, and positive experience for all participants.
