Nature Explorers Program Policies & Participation Agreement
PARENTAL CONSENT, ASSUMPTION OF RISK, INDEMNIFICATION & MEDIA RELEASE
1. Program Description
This agreement applies to participation by my child in outdoor skills, environmental, and nature-based education activities offered by Kolibri Education & Consulting, LLC, which may include hiking, nature exploration, outdoor games, environmental education, use of natural materials or age-appropriate tools, and related activities (the “Program”).
2. Parental Consent
I am the parent or legal guardian of the minor named below. I give my permission for my child to participate in the Program and understand that participation is voluntary.
3. Assumption of Risk
I understand that participation in outdoor and nature-based activities involves inherent risks, including but not limited to uneven terrain, slips, trips, and falls; exposure to weather, insects, plants, and wildlife; physical activity and use of natural materials or tools; and outdoor locations where immediate medical care may not be available. I knowingly and voluntarily assume all risks associated with my child’s participation, whether known or unknown, foreseeable or unforeseeable.
4. Release of Parent Claims & Indemnification
To the fullest extent permitted by Maryland law, I agree to release and waive any claims I personally may have against Kolibri Education & Consulting, LLC, its owners, instructors, employees, and volunteers arising from my child’s participation, except in cases of gross negligence or willful misconduct; and I agree to indemnify and hold harmless Kolibri Education & Consulting, LLC from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of my child’s participation or my failure to follow Program policies. I understand that this agreement is intended to clearly outline responsibilities and risks associated with participation in the Program.
5. Medical Authorization & Disclosure
I authorize Kolibri Education & Consulting, LLC to obtain emergency medical care for my child if deemed necessary. I understand that I am financially responsible for any medical treatment provided. I understand that disclosure of medical conditions, allergies, medications, or special needs is voluntary; however, Kolibri Education & Consulting, LLC cannot accommodate or respond to conditions that have not been disclosed, and I accept responsibility for any risks associated with non-disclosure.
6. Program Expectations & Safety
I understand that participants are expected to follow all safety rules and instructor guidance. Kolibri Education & Consulting, LLC reserves the right to remove a participant for unsafe or disruptive behavior, without refund.
7. Media Release
I understand that photos or videos may be taken during Nature Explorers activities as part of documenting and sharing the program experience. Identifiable images may be shared privately with enrolled families only. For public-facing materials, Kolibri Education & Consulting, LLC will use only non-identifiable images (for example, where faces are not clearly visible). Images are used thoughtfully and respectfully to reflect the nature of the program. If I have specific concerns, I understand I may contact Kolibri Education & Consulting, LLC to discuss them. I acknowledge and agree to this photo policy.
8. Governing Law & Venue
This agreement shall be governed by the laws of the State of Maryland, and any legal action shall be brought in a court of competent jurisdiction within Maryland.
9. I understand that the registration form gives permission for my child to participate and explains the risks involved. I acknowledge that participation in outdoor activities involves inherent risks, and I accept responsibility for my child’s participation to the fullest extent permitted by law. Nothing in this agreement is intended to waive my child’s legal rights.
